These are pictures of the Friday plane crash in Aransas Bay. The plane went down just short of the condos. I understand that Christie(208), who is a nurse, took charge of the young boy who was on the plane. She put him in a warm shower and found some dry clothes for him.
The latest word is that the plane took off from Corpus and just ran out of gas. (Remember the pictures can be enlarged by clicking on them.)

I am in San Antonio this week for Thanksgiving with the family. Pat(602) sent this email.

Larry,

Just happened to turn on the computer to the Kontiki security cameras this afternoon around 1:30 or so and saw three ambulances and a Sheriff's vehicle parked between the 300 and 500 units of the Kontiki. I could only see that they loaded one person on a stretcher and into an ambulance. There were people looking out toward the bay between the 300 and 200 units. The security camera does not show the bayside.

Anyway, after an hour or so, I called the Kontiki desk to find out what happened. They told me that an airplane had gone down in the bay and 4 people had been rescued, with no fatalities.

I received a phone call a few minutes ago from a friend of mine who told me that he was fishing in the bay and saw the plane go down. As soon as it hit the water, he and his party immediately pulled anchor and went over to where the plane went down. There was a Pescador there already and the passengers were loaded onto the Pescador. David called EMS and told them that the Kontiki was the closest place for the ambulances to get to the survivors. David said that the EMS was there at the Kontiki when they arrived. Very fast response time! The Pescador did not know how to get in to the Kontiki, so David escorted them to the Kontiki channel. Must have been some irate fishermen on the pier as David and the Pescador did not slow down in order to expedite the survivors to the dock. He said that they were hollering at them as the came in to the dock.

I must assume that the airplane was a fixed gear in that it did not skid along the water as would be the case of a retractable gear airplane and a good landing. David said that the depth of the water was around 9 ft. Also, that there was no evidence of gasoline on the water, making me believe that the airplane ran out of gas.

It will be interesting to find out further details

OK. This time I am showing off. One day after catching the biggest red of my life, I catch the biggest flounder of my life. This one was just over 24 inches long and very heavy. It was an unlucky fish in that the hook was not even in his mouth. It was snagged on his dorsal fin just behind the head. I bought these extra sharp stainless steel hooks and they seem to snag anything that gets close, including me. This flounder hit a perch that was staked out off the back deck. The daily limit for flounder is two this month. Its been a long time since I got half a limit of anything. The Maldonado family from San Antonio helped me with the picture.

Paul(505), Scott(504), and myself had a successful day of fishing. This is a 40 inch red that made our day. We left this morning and went 12 miles out into the Gulf. The water was almost smooth. We tied up to a rig in 75 feet of water. We caught several red snappers, but they cannot be kept this time of year outside the 9 mile mark. Another boat of five anglers pulled up to the same rig and began to keep everything they caught. We were not too happy about that. We moved back toward shore and caught this red in about two feet of water in the surf. It hit a clear DOA and with 12 pound line it took a while to bring it to the boat. This is Scott's boat in the background.
The storm did a lot of damage to the Phase I pier. J.R. sent a guy out today to repair it. I saw twelve boards that were completely gone and about 30 more that were displaced, but could be recovered. Later this evening there was an electrical issue under the 500 building and the same guy was sent out to check out the problem.
Several units has water damage from the rain. I cleaned up all that I could in my place, but now the carpet is starting to dry out and smells pretty bad. J.R. sent someone out today to check the roof where the leaks occurred.
Scott C. came to work Saturday morning, but was told that since his last day would be Sunday that he would not be allowed to work the last two days.

The rain continues to fall with thunderstorms in the area. The wind has changed direction and the wave action has subsided. I have had to put towels around the east facing windows and doors. The force of the wind has driven rain water through crevices that I didn't know existed.
I have been here when we have had near misses by hurricanes, but the last twelve hours have been the worst weather I have experienced here. It is pouring right now and the forecast is for it to continue. The Aransas Airport has had nine inches and Lamar Peninsula has had eleven inches. The high winds and storm conditions have been relentless. I don't see how anyone on the bayside got any sleep last night. The waves pounded the seawall all night and plumes of water shot about twenty feet into the air.
I was able to make a quick trip outside during a lull at daybreak to assess the damage so far. The Phase I pier is taking a beating. I can see some missing boards, but I don't know how many. The lights quit working during the night. There is some washout near the start of the pier. The new grass is doing its job and forcing water back over the wall and under the last few units on the 300 building. About 40% of the grass is under water and will die from the salt unless it can be rinsed with fresh water soon. The swimming pool is flooded.

I would expect most all roads to be closed. Some already are.

We have had some really great weather this week, but today, not so much. Tomorrow the forecast if for 90% chance of rain. The tide is way out right now and I'm sure it will get even lower.
I helped Scott C. take the Purple Martin houses down for the winter and put them in storage earlier this week. Sunday will be Scott's last day to work for the HOA. He will be taking a job with the City of Rockport. He has been a real asset for us and will surely be missed. This morning he caught three trout before punching in to work. The largest was 19 inches. He caught them all on top water lures just north of the pier. I tried a DOA shrimp and landed a 16 inch flounder. Yesterday, I caught the largest gafftop ever from off the back deck. I thought I would be eating gafftop for lunch, but now its going to be flounder. I'm going to take it to Alice Faye's and let them cook it.
I last posted that Sears had a really good sale going. I guess Rob saw that post in California because Cleve, Sears owner, said that Rob called from California to order an on sale dishwasher. Today I went in to look at bedding. They had foundations for king size beds on sale for $139 each, but while I was there they marked them down to $29.93 each. Yes, I did buy them. I'll get the mattress later. They are planning a big sale for Black Friday. They say they will have a 50" LCD TV for less then $500.
Mimi and Bridget(707) were here this week enjoying their new condo. They left the guys at home.
I understand that some of the other condos owned by the Chris and Karra will be put on the market soon. I believe they will all be one bedroom units, although they may include two three bedroom units, but I am just speculating from what I have heard.
Fishing off the pier has been hit and miss for even small trout. One night I catch two at a time and the next night I get no bites at all. I went out at 5 am this morning to give it an early morning effort and did not get a bite.

After I caught my first ever keeper trout off the new pier on Friday, I got another one on Saturday evening. However, last night the string was broken. Steve and Jane(711) and Vic(712)and I stayed on the pier until about 1:00 am and never got a keeper. It is interesting that, to us, the conditions on Saturday and Sunday were identical and yet the fishing was quite different. Sunday was a record high temperature for this date.

Rob added this closet in 710 last week. It's about four feet wide and eight feet deep. It was just empty space behind the wall. Steve and Jane(711) looked at it on Saturday and have asked Rob to build one in their condo too. Butch and Lynne(206) have asked Rob to add a door in their condo. Three other owners are considering complete remodels. It looks as if Rob will be here longer than he thought.
The local Sears store has purchased the inventory of a Sears store in the valley. The appliances and items that are unboxed will be marked down by 40%, according to Cleve Woods the local owner. That could be a good buy for anyone needing an appliance.
Three owners tell me they still don't have a winter Texas booked into their condo. I had heard the place was going to be pretty full and it still may be.

Finally, after two months of trying, I caught my first keeper trout off the new pier last evening. I used my usual tandem white cocohoe. The trout was almost 16 inches. I did notice when I filleted it there were no parasites this time. My theory is that with all the new water in the bay from rains and high tides, some trout are now here that were not here this summer. I think the ones full of parasites were ones that spent the summer in the bay system and were stressed.
Wally and Bunnie(406) and Dawson(dog) went back home to Belton today. They had been here for about ten days. Pat and Murlin(506)and Dollie(dog) left on Thursday. Sandy(107) got back from her cruise to Mexico today. Rob(303) is leaving for California tomorrow. He'll be back later in the week. Scott and Amy(504) have worked non stop on redoing their condo this weekend.
Chris told me on Thursday that the bill that I questioned at the meeting on Sunday was to be reimbursed to the HOA. The $150 of palm tree trimming was done at their fitness center. He said he is anxious to get all the questionable bills resolved by the end of the year. That's good news to me. Alan(108) plans to come in before Thanksgiving to help in reviewing the HOA finances. I'm encouraged that we can resolve all the monetary issues that have been dragging on.
I've been told that Justin has resigned as our HOA property manager.
I am still very disappointed that the leadership of our HOA would capriciously deny an owner the right to vote at the annual meeting. The receipt below demonstrates the folly of the illconceived plan to disquality a vote. This owner had traveled over 700 miles to be here for the meeting. His payment was sent to Commericial Insurance Solutions on October 13th. The board chose to erronously post this to his account on the afternoon of the last business day before the meeting. What would have happend if an issue before the council had been ajudacated by a single vote and this error had not been found until the next business day after the meeting? I hope this never again occurs in our HOA. I do not know why the leadership so feared the vote of the owners that actions such as this were undertaken.

The weather service lists today's high tides as about one foot above normal. It looks like more than that here. Above shows the mitigation site plum full of water. This is predicted to last another 48 hours with a high tide tomorrow morning.

The corner of the HEB property continues to work toward out entrance road. It is interesting to notice the well defined high water mark of oyster shell.

This is the barometer I use for really high water. The mitigation site overfills and sends water up the drain pipe where boats are washed. The water then stands on our entrance road.

This is a copy of the agenda used for the annual meeting. You will have to double click on the image to read it.
The room arrangement was something I had asked for last year. The chairs were in a semicircle so everyone could see each other with the board in the middle. The room was very crowded when the large gathering that I expected arrived. More chairs had to be brought in. More copies of handouts had to be printed. I'll try not to go into great detail with my observations of the meeting because it lasted four hours and much dialogue took place.
The board had met for a great while at Richy's house on Saturday to prepare for the meeting. There was again no notice of the meeting. They had reviewed the questions
that I had posted on Monday and prepared some responses.
The first item on the agenda was not done. No quorum was established nor total votes reported. The best that I could find out was I held six proxies, Scott three, Randy one, Rob one and Betty one. One owner asked for a roll call of units to determine who was present and what proxies were held. That didn't get very far. No introductions of the owners or even the new owners was done. Richy spoke a few minutes and then Karra chaired the meeting. The largest ever crowd made it difficult to conduct business and there were many digressions an interjections.
Justin gave a property manager report, but the topic of Budget vs. Actual cost, as on the agenda, was not reported. The only conclusion was that we were over budget and the tennis court fence will not be done this year.
The outside GFI plugs will be replaced, a gasoline powered cart will be purchased, breakwater repairs will be done to restore it to original condition, and the finger piers will have improved tieups. This will be paid with a one time $160 assessment. The previous payment to Kinsel and Company to repair the breakwater will just be a loss. Scott and Rob will serve on a committee to seek a solution to the problems of channel maintenance.
The adopted budget will require $270 monthly dues. I noted some problems on the reimbursement in the present budget, but Karra said that the information supplied at the meeting was not up to date and a payment had been made from Phase II to Phase I. Alan(108) and I were appointed to serve on a finance review committee to review and monitor the association financial expenditures and records and report any problems we find. This was in lieu of the expense of a financial audit that was rejected by a vote of the council.
It was decided that we may be under insured for the present conditions of the condos. The board will begin work to amend the by-laws to allow for insurance to restore units to present condition rather than to original condition.
Scott(504) and Rob Mabe were elected by acclimation to serve on the board. Rob had sold his unit 407 some time ago, but in was announced that he was the new owner of 303.
Next year's meeting will be held on the second Saturday in November.
Now for the sidebars. It appears as if about 60 people logged on to this blog yesterday. That is a record number for one day. I can only guess they were looking for meeting notes, so here they are. Some owners felt not enough action items were voted on, but the mere presence of such a large crowd put the board in new territory. I thought the board was in a capitulation and damage control mode. There was a deluge of questions about communications, transparency, and accountability. The board agreed to provide minutes of this meeting within 30 days, allow owners to attend board meetings, and in general be more accessible and improve communications. It had been years since I had seen such a conciliatory attitude.
Karra said all the loans would be paid out in five years. As I recall the loans approved by the council were to have four year terms.
The question of what happened to the $25,000 assessment for building the 'L' to prevent shoaling in the channel was asked. The answer was that it was absorbed in ancillary costs. No details were provided. Phase II will meet next Sunday and perhaps they will be provided the details of where their part of the money went.
Karra commented that this blog has been a source of incorrect information. I should hope not. I told Justin long ago that if he saw anything that he deemed incorrect in this blog, that I would publish his response in its entirety verbatim. I will extend that offer to any board member too. Just send me an email and I will post it.
One new owner had driven in Sunday morning to find that he could not vote because he was one month behind on his dues. He said he offered to pay the board a whole year's worth of dues in check or cash to clear his account, but was told that the board does not accept money and he could not vote. I would think that if money were offered, the board would accept it.
The low light of the meeting, for me, came when the election of board members came up. We had been voting all day without question of who could vote. Suddenly Karra holds up a sheet of names of owners who had not yet paid Commercial Insurance Solutions for their insurance. She said only 47 owners could vote. Some members stated they had not received a bill. That may or may not be, but I had been to Johnson and Cate on Thursday and obtained a copy of delinquent dues and showed it to Karra. There was no mention of insurance delinquencies on it. She said the list was updated on Friday. The outstanding dues had been turned over to the HOA for collection. There were eight owners on the list who were to be denied a vote. As if rehearsed, one owner shouted,"I paid mine. They should pay theirs". That is not the point. Our declaration says the monies owed to the HOA have to be delinquent to deny a vote. The HOA had not paid the insurance company. They were not out the money. The owners had not been billed by the HOA. The declaration says owners are not delinquent until 10 days over due with payment to the HOA. The board meeting was on Saturday and the list of delinquencies was updated on Friday. So this means an individual told Johnson and Cate to update before the meeting in a blatant attempt to deny owners their vote.
I had anticipated such a move and read the pertinent clause from the declaration to the board, but it fell on deaf ears. Perhaps there was no other candidate for the board because those who could not vote would have to have been identified. This type of subterfuge has to stop. For the first time in years, the board did not have the prevailing votes at the meeting and this was an attempt to maintain what control they could.
Overall, I feel progress was made. I'm seeing good things I have not seen in years, perhaps this bus has turned the corner and we are off in new direction. Most owners just want to enjoy this place and not have to worry about what is happening that might impact them. When information is hard to come by, suspicions arise. I think a new openness will serve us all well.
I thought some newer owners distinguished themselves with pertinent comments and demonstrated leadership. Dustin Martinez(605) contributed some good ideas. Angela Koemel(108) interjected some cogent remarks and suggestions.
This letter to the editor appeared in a recent issue of the Saltwater Angler. I had not heard of a monetary motivation.

I have been reading with great interest the discussion of trying to open Cedar Bayou. I have fished Cedar Bayou since I was knee high (the late 60’s until the last few years when it sanded over). I have never experienced such a magical place abundant with marine life, so peaceful to camp on the bank for a couple of days, wade the edges and load up a stringer of various fish. I am saddened over the fact that greed and money has delayed the re-opening of his important pass. Of all that I have heard and not that I am knocking the wealth and power that the Bass family has, but don’t you think that major money is involved here? I mean think about it, the Bass’s run cattle on San Jose and Matagorda. If the Pass is closed, the cattle are free to cross and roam both islands. When the Pass was open on numerous occasions I have encountered cattle on the San Jose side wanting to cross but the water was too deep and swift. I even saw a cow get hooked by a fisherman throwing a cocahoe minnow! If the pass was reopened, well then the Bass’s would have to ferry the cattle back and forth, hence labor costs, fuel costs and maintenance on the ferry. I can see no other reason why the hold up of such an important issue other than a great deal of money is involved. Soon the Whooping Cranes will be making their way down here only to find no marine life to feast upon because no fresh salt water is flowing into the estuaries. It is sad, real sad. I have read about the grasses vanishing from Copano to San Antonio Bay. I believe this is a direct result of “no flow” from the Pass. I am sure the lack of fresh water and rain has an impact as well. The longer we wait to open it, the worse our ecosystem here will become. I’m no biologist nor am I college educated but I can tell you, money is the largest problem here concerning Cedar Bayou. Little people like myself can only write letters and complain to each other. We have not the power and influence to change the corrupt ones. How dare the fat cats in office, sit there and decide what is best down here. Yet they spend our tax dollars on some other needless program.
Sorry for being so long winded but I had to respond in light of your comments on Cedar Bayou. I guess the good old days are gone.
The pot luck owners' dinner was a huge success on Saturday evening. Christie(208) and Angela(108) did a really super job in organizing it. We probably had enough food for a week. Rob and Scott C. fried the fish in peanut oil outside and we even had some of that left over. I put away all the fish I could handle. I will have some pictures to post later.
The fishing tournament winners were Jim and Christie(208) with a 17 5/8 inch trout and Randy(308), son in law, Jason, and grandson, Colson brought back the biggest red at 22 7/8 inches. Scott(504) donated some fish from his freezer. We all had a great time.
Did anyone notice I put "Scott(504)"? I am used to listing "Scott(702)". On Friday Scott and his family purchased Barbara and Jim's unit. The same day, they sold theirs to Steve(703). There was a lot of moving going on all weekend as Scott and family switched furnishing and contents between the old and new condo.
I hope to get my notes of yesterday's owners' meeting posted later today. It was very interesting. Stay tuned.

AUSTWELL - Endangered whooping cranes appear to be in the southern half of their migration corridor and could be arriving as soon as next Tuesday, a spokesman for the Aransas National Wildlife Refuge said.

The refuge has five birds at its Austwell facilities. Two of the birds stayed over the summer, said Tom Stehn, whooping crane coordinator for the refuge.

Two birds arrived on Oct. 16, and one came on Oct. 19. Stehn said two more were sighted in Matagorda Island Wednesday afternoon.

Arrivals are about a week behind schedule, Stehn said.

"This is very unusual," he said, adding that he would expect about 100 cranes to be there at this time of year. "I have never had a year with November hitting, and there aren't at least two or three dozen whooping cranes here."

Whooping cranes were spotted in the following locations:

Southeast of Fort Worth - seven on Oct. 28.

Ganado - two on Oct. 31.

Burwell, Neb. - five on Monday.

Near Salt Plains National Wildlife Refuge in Oklahoma - groups of four and eight on Monday.

Greenfield, Okla. - four on Monday.

Near Salt Plains National Wildlife Refuge - two on Wednesday.

During my time of ownership I have seen four condos flooded by water leaks during the time the unit was unoccupied. Owners are now pretty sensitive to the issue and many turn the water supply off when they are not here. The control values are, for the most part, very difficult to access. This shutoff was installed on one unit and it makes the task simple. I need one of these on mine. Reaching under the building gets more difficult all the time.

It's dove hunting season in Texas. These Whitewing doves on my window ledge in San Antonio have found a place for food and avoid having to go to the fields and take their chances. The most I have seen here at one time is eleven. There would be more, but they push each other off.
I'm expecting a record number of owners in attendance for the annual meeting. It will be good to see everyone again and to meet the newest owners. Since so many will be here, proxies will not be in abundance. If fact, there may be a bounty for those who can deliver one. Some people who are not even owners are searching to find and obtain proxies for board members.

One item that appears on the agenda of both Phase I and Phase II is insurance. In recent years I have not felt comfortable with our level of coverage. I asked our agent on the 28th of August just what coverage we have. She responded with "We are glad to be able to continue our relationship with the Kontiki HOA. As we have discussed, the condos will be built back to "original construction" (+ any required updates such as hurricane straps). If owners have updated countertops to granite they will not be built back with granite, but laminate etc."
In other words in the event of a loss, the condos would be built back just as they were in 1983. Even the lofts that have been added through the years would not be covered. I have put over $30k in upgrades into my place and I want more coverage. Our declaration is rather unique in that the umbrella policy covers much more than just the wall studs out. I questioned her about the proration of costs of insurance that was not in accordance with our declaration. I had mentioned this to her last year and pursued the subject at our owners meeting. She said she understood what our declaration said, but she was doing as our board told her to do. The three bedroom units were being overcharged. To get my foot into the door I filed a complaint with Texas Department of Insurance. That really got things going. It was being said that I was going to cause us to lose our insurance. Below are several pages I got back. It will be necessary to click on the images to be able to read them.


Notice in these two pages the agency shows they are insuring 64 condos. Where are the other two located? They show a per unit cost as our declaration says should be done. This is correct, but when our agent computed the cost she divided the total by square footage thus increasing the cost for three bedroom units.

I'm not sure about the veracity of the answers checked on items 12,13,15,16,and 18.
We do share two employees. The remodeling inside the units may or may not relate to items 12 and 13. We had some items stolen from unit 101 recently.
People have learned after Katrina that the time to ask insurance questions is before a loss, not after. I hope I can have mine answered at the meeting. I understand our agent will be there.

The page above shows we are insuring (2) tennis courts. Where is the other one? It shows one fishing pier, but Phase I paid the major portion of the new pier. Do we have to have any liability coverage for that?

The page above shows one insured as a business that has nothing to do with our HOA. I believe it is a business of one of our board members.

By now I'm sure all owners have received the notice of the annual meeting to be held next Sunday. The most important issue on the agenda will likely be our money problems. Off and over budget expenses have reached $405,534 for the first nine months of this year. Last year we finished $62,525 over budget. This is hard to understand when our declaration limits the board to expenditures of less than $1,000 for over budget alterations and improvements except for needed repairs. From 2000 through 2005 the off and over budget items ranged from a low of $10,155 in 2002 to a high of $30,651 in 2003. A far cry from what has happened recently. The association year ending equity from 1997 through 2004 ranged from a high of $54,016 in 1998 to a low of $31,257 in 2004. Through September of this year, we are $112,184 in the red. There is no doubt the place was turning into a fish camp and it looks great now, but at what price. Very few owners keep up with the finances and there have been no notifications from the board concerning finances. I have not talked to any owners who were aware that another $41,000 loan was made to the HOA this spring just to keep the finances afloat. This was on top of the $150,000 loan that had been approved earlier by owners. For notes on previous years owner meetings, my blog notes for the months of November each year contain the synopsis.
It will be so important to elect board members who will try to balance the budget and keep owners informed. Even voting for board members has been problematic in that the board asked for owners to sign the ballots. They seemed very interested is seeing how owners voted. In recent years the board members have arrived at the meeting with enough proxies added to their own units to constitute a majority vote and even though they listened to owners, the board had the final say on all matters. Some owners did not bother to attend the meetings because they knew their vote would have no impact. I may be painting the "board" with a broad stroke. I'm not sure who the officers are and who makes the decisions. I contacted one member and he said that in his one plus year on the board he has received no board communications nor been notified of any board meetings.
This year there are some budgetary issues that have not been advertised. The breakwater is coming apart on both sides of the channel. This could be costly. We were assessed for $25,000 earlier this year to address some of the breakwater and channel issues, but nothing has been done and I don't know if that money is still available. The swimming pool needs major repair. We will be required by the GLO to do a survey of the beach area and address any problems created by the breakwater. This too could be costly. One owner had an assessment made on the problem of dryer vents. The consultant noted that the vents are vented into the attic space and would not meet building codes anywhere. Do we need to correct this or live with the hazard that the venting presents? The venting is between the walls and into the attic and would be an HOA expense. The golf cart is on its last legs. We need to look at buying a new one or maybe going to a gas powered cart. Golf carts were not designed to drag the beach the way we do. The outside decks all have electrical outlets. They need to be changed out to GFI outlets. Without replacement we likely have liability exposure for shock hazards. The tennis court fence is about to fall down and was supposed to have been replaced with all the other capital improvements. Wireless internet service needs to be improved. Boat tieups at the finger piers need to be improved. Pool furniture needs to be replaced. I would guess the board would bring us estimated costs for these items so they can be budgeted.
There are some questions that owners beside myself would like an answer to such as: Do we plan to have an association HOA audit as required by the Uniform Condominium Act? We have not done so in a decade. I would rather see the board appoint a committee of owners to do an operational audit. I look over the monthly bills on occasion and we are being billed for any number of expenses that are not ours. I don't believe there is any willful intent to misappropriate the money, just benign neglect and inexperience. The amounts are not excessive.
How are the new pier electrical expenses being paid? I estimate the cost to be about $15 per night. Are they being shared with Phase II? We are supposed to be sharing the cost of Pop and Scott with Phase II, but I have not seen a reimbursement made in quite some time. One of the shared employees had an accident earlier this year and Phase I paid the hospital expense. Should that have been shared?
What has happened to our fixed asset inventory? We used to have a list of all our owned equipment. Can we set up a central repository for association records to include, financial information, current leases, contracts, agreements, meeting minutes, declaration, and asset inventory? Can we have a breakdown for the items that are so far over budget? For example the association insurance is 276% over budget, Repair and maintenance other is 283% over, pest control is 122% over, pool supplies and maintenance is 121% over, and security is 29% over budget.
I believe this will be a very important meeting and hope that every owner can attend. There will be many new owners to meet and greet. So far I know of fourteen new owners.
